In addition to paying the named amount, the service was obliged to make adjustments to the privacy rules and take a number of additional measures to protect users of its social network.
Legal regulation of the collection and processing of personal data on the territory of the Russian Federation is carried out by the relevant regulatory legal acts, including Federal Law No. 152 of July 27, 2006 "On Personal Data". The law contains the following definition of personal data: personal data is any information relating directly or indirectly to a specific or identifiable natural person (subject of personal data). The processing of personal data is any action (set of actions) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification, updating, modification, extraction, use, transfer, distribution , provision of access, depersonalization, blocking, deletion, destruction. Personal data is processed with the consent of the subject of personal data to the processing of personal data. Consent to the processing of personal data can be given by the subject of personal data or his representative in any form that allows to confirm the fact of its receipt.
According to the provisions of Chapter 2 of the Law on Personal Data, biometric personal data are allocated as personal data.
Biometric data is information that characterizes the physiological and biological characteristics of a person, on the basis of which it is possible to establish identity and which is used by the operator to establish the identity of the subject of personal data. In cases where the images of the subject of personal data are processed to establish identity, they are recognized as biometric personal data and can be processed only with the written consent of the subject of personal data. Such written consent will be the user agreement accepted by the user.
Tik-Tok, changing the terms of the user agreement, is obliged to inform users of the social network about the changes. This obligation is expressed either in the mailing of modified agreements to the email addresses of users, or in the appearance of a corresponding notification in the application itself. If the user does not accept the terms of the user agreement, he cannot use the application (a similar situation occurred with Whats'app).
The purpose of collecting such data is primarily for advertising. Tik-Tok, like other similar services, makes significant money by partnering with advertisers. For the purpose of demonstrating targeted advertising to users, TikTok segments the audience by many indicators, including age, country of residence, hobbies, and etc. As a result, advertisers have an extensive database with a huge amount of information, based on the analysis of which, advertising is shown exclusively to the target audience, which favorably affects the sale of relevant goods and services.
Answering the question of whether such changes will affect the popularity of Tik-Tok, it is worth paying attention to the user agreements of other similar services, which have long contained provisions on the possibility of collecting user biometric data, but this does not affect their popularity in any way.
